6. How do I get a refund?

Refunds for an S111 are not automatic and must be requested in writing. You may request a refund if: 

  1. Planning permission for the development was refused, and no appeal lodged within 6 months. The refund must be claimed within 12 months of the refusal date. 
  2. A planning appeal has been dismissed. The refund must be claimed within 6 months of the appeal decision. 
  3. Planning permission for the development was approved but not implemented and the permission has expired. The refund must be claimed within 6 months of the relevant date. 
  4. The planning application was withdrawn. The refund must be claimed within 6 months of the withdrawal date. 

If the planning application is varied by a Section 73 application or amended, then the Habitat Mitigation payment may be used to cover the payment due for that application. A new form will need to be submitted. ? 

There are no refunds for the administration and monitoring fee for a Unilateral Undertaking.
